Terms and Conditions

These terms are a contract between you and Dead Simple Backups ("we", "us"), which runs the backup service at deadsimplebackups.com (the "Service"). By subscribing to or using the Service you agree to them. If you do not agree, do not use the Service.

Three things are worth reading before anything else, because they are the ones people are surprised by later: we copy only what is public on your site, we never sell your information, and checking your backups is your job, not ours. Sections 3, 5 and 7 set those out.

1. What the Service is

We crawl the public pages of a website you control, save each page as HTML with a full page screenshot and the images, styles and fonts it uses, package that into a zip file, store it, and email you a private link. We do this once a month, and once when you first subscribe.

2. What the Service is not

This matters more than anything we do, so we state it plainly.

3. What we copy, and what we do not

Public pages only. We read your site exactly as an anonymous visitor does. We never ask for, hold, or use your website login or password. We have no access to your builder account.

We honour robots.txt. If your site's robots.txt excludes a path, we skip it. If you want a section left out, add it there.

We skip protected content. Pages behind a password, a member login, or a paywall are not accessible to a visitor and are therefore not in your backup.

Limits apply. Each backup is subject to published limits on pages, size, files and time. Current limits are documented at deadsimplebackups.com/help/limits-on-pages-and-size. We raise them per site on request at no extra charge. Where a limit is reached, we deliver everything that fit and tell you in the email, on your dashboard, and in the report inside the zip.

4. Your site, your authority

You confirm that for each site you add, you own it or are authorised by its owner to have it copied. If you are a designer or agency backing up a client's site, you confirm you have that client's permission.

You may not use the Service to copy a site you have no right to copy. We will act on any credible report that you have done so, including suspending the account.

5. Privacy

We are built to hold as little about you as possible.

We do not sell your information. Not to advertisers, not to data brokers, not to anyone, in any form, for any price. We do not share it either, except with the service providers listed below who are needed to run the Service, and where the law compels us.

What we hold about a subscriber: the email you used at checkout, your site address, your plan and its Stripe identifiers, when it started and renews, and your backups. Card numbers never reach us; Stripe holds them. We also keep basic product analytics about use of our own website, unless you block them.

What we hold for a free preview: the address you pasted, the resulting files for 7 days, and an email address if you chose to leave one. Rate limiting uses a one way hash of your connection's address, kept for two days, never the address itself.

Who we use to run the Service: Stripe for payments, Resend for email, Cloudflare R2 for storage, Netlify for the website, GitHub Actions to run the backup worker, and PostHog for product analytics. Each is bound by its own terms and processes data only to provide its part of the Service.

Who can see your backups. Backups are held in private storage. They are reachable only through the unguessable private link we email you and through your dashboard. Anyone holding that link can open that backup, so treat it as a password. We do not publish, index, or share your backups.

Deletion. You can delete any backup yourself from your dashboard at any time. To have your account and everything in it removed, write to hello@deadsimplebackups.com and we will do it.

7. Verifying your backups is your responsibility

Read this section twice if you read nothing else.

A backup you have never opened is not a backup. It is an assumption.

When each monthly email arrives, it is your responsibility to:

  1. Download the zip.
  2. Open it and confirm it contains what you expect: the pages that matter to you, the screenshots, and the images.
  3. Do this when the email arrives, not on the day you need it.

We give you the tools to make this quick. Every email states how many pages, screenshots and files the backup holds, and how that compares with the month before. Every backup contains a report naming anything that was skipped or any limit that was reached. Your dashboard shows the same.

If you find a problem, tell us. Write to hello@deadsimplebackups.com within 30 days of the email in question, describing what is missing or wrong. We will investigate, and we will make reasonable efforts to correct it, which may include re-running the backup, raising a limit for your site, or changing how we crawl your site. We will tell you what we find either way.

What we cannot do is fix a backup you look at for the first time a year later, of a site that no longer exists. By then the pages we would need to re-read are gone. This is why the check matters when the email arrives.

8. No warranty, and no liability for data loss

To the fullest extent permitted by law:

The Service is provided "as is" and "as available". We make no warranty, express or implied, that the Service will be uninterrupted, timely, secure, error free, or that any backup will be complete, accurate, current, or fit for any particular purpose.

We are not responsible for loss or corruption of data. This includes, without limitation: loss, damage, corruption or deletion of your website; loss or corruption of any backup or any file within it; pages, images or content missing from a backup for any reason, including site changes, crawling limits, robots.txt rules, outages on your site or ours, protected content, or technical failure; any inability to rebuild a site from a backup; and any loss of business, revenue, goodwill, or anticipated savings arising from any of these.

Your backups are a second copy, not your only copy. You remain responsible for your own website, its content, and its safekeeping. Do not treat the Service as your sole protection against loss.

Liability cap. Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the amount you paid us in the 12 months immediately before the event giving rise to the claim.

What we do not exclude. Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you may have rights under your local law that these terms do not affect.

9. Availability and changes to the Service

We aim to run every backup on schedule and to keep the Service working, but we do not offer a service level guarantee. Backups may be delayed by outages on your site, on our providers, or on ours. If a backup fails we tell you, and we try again.

We may change, add to, or discontinue parts of the Service. If we discontinue the Service, we will give you reasonable notice and a period in which to download your backups.

10. Retention

While your subscription is active we keep the last 12 months of backups for each site. After cancellation we keep them for 30 days, then delete them. You can delete any backup sooner yourself. Once deleted, a backup is gone and cannot be recovered.

11. Designer and affiliate accounts

Designers who sign up through our designer programme receive one free backup of their own site and a code giving their clients a discount on a first year. Free partner sites are provided at our discretion and may be ended with reasonable notice. Everything else in these terms applies to them unchanged.

Affiliates who sign up through our affiliate programme receive the same free backup of their own site and a code that gives the client 10% off a first year and earns the affiliate a referral fee, currently US$20, for each site that starts the yearly plan through their link and remains active 30 days later. No fee is earned for sites the affiliate pays for themselves, sites on the monthly plan, sites that used a designer discount code, or sites cancelled or refunded within those 30 days. Fees are paid at the start of each calendar quarter once a payable balance exists; we contact the affiliate by email to arrange each payment, through a service such as PayPal. Affiliates must not make claims about the Service beyond what this site says, and must disclose the referral relationship where the law requires it. We may withhold or reclaim fees that arise from fraud, self-referral or abuse, and we may change or end the programme with reasonable notice; fees already earned are paid.

12. Acceptable use

Do not use the Service to copy sites you have no right to copy, to overload any website including ours, to break any law, or to work around the limits or protections described here.

13. Suspension and termination

We may suspend or end an account that breaches these terms, that is used to copy sites without authority, or whose payment fails and is not resolved. Where circumstances allow we will tell you first and give you a chance to download your backups.

14. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change materially reduces your rights we will tell subscribers by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.

15. Governing law

These terms are governed by the laws of the State of Texas, United States of America, and the courts of Travis County, Texas have exclusive jurisdiction, except where your local consumer law gives you the right to bring proceedings elsewhere.
